Empresariales?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-33d434e elementor-widget elementor-widget-text-editor\" data-id=\"33d434e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En t\u00e9rminos generales, los secretos empresariales consisten en informaci\u00f3n que, por su valor estrat\u00e9gico y por las ventajas competitivas que otorga a la empresa, es tratada como confidencial. Tradicionalmente, los secretos empresariales se proteg\u00edan mediante diversas disposiciones dispersas en diferentes cuerpos legales y a trav\u00e9s de espec\u00edficas cl\u00e1usulas contractuales. Sin embargo, desde la promulgaci\u00f3n de la Directiva (UE) 2016\/943, de 8 de junio de 2016, relativa a la protecci\u00f3n de los conocimientos t\u00e9cnicos y la informaci\u00f3n empresarial no divulgados (secretos empresariales), contra su obtenci\u00f3n, utilizaci\u00f3n y revelaci\u00f3n il\u00edcitas, y su consiguiente transposici\u00f3n en los ordenamientos nacionales, los pa\u00edses de la UE en general y Espa\u00f1a en particular cuentan con una regulaci\u00f3n especifica y moderna sobre esta materia.<\/p><p>La citada disposici\u00f3n establece el concepto de secreto empresarial. Lo define como aquella informaci\u00f3n valiosa que es secreta en el sentido de que no es generalmente conocida dentro\nde los c\u00edrculos que normalmente se ocupan del tipo de informaci\u00f3n en cuesti\u00f3n; que tiene valor comercial por ser secreta; y que ha sido objeto de medidas razonables por parte de la persona que legalmente controla la informacion, para mantenerla en secreto.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-33 elementor-top-column elementor-element elementor-element-e6a99dc\"
